These Terms of Service ("Terms") govern your access to and use of the website located at tuwuba-rugole.info and your participation in tours offered by Tuwuba Rugole Food Tours ("Company," "we," "us," or "our"). Please read these Terms carefully. By using our website or booking a tour, you agree to be bound by these Terms. If you do not agree, do not use our website or book a tour.
A. Acceptance of Terms
These Terms constitute a legally binding agreement between you and Tuwuba Rugole Food Tours. Your use of our website or participation in any tour constitutes your acceptance of these Terms and our Privacy Policy. We may update these Terms from time to time, and the updated version will be posted on this page with a revised date. Continued use after any update constitutes acceptance of the revised Terms.
If you are booking on behalf of a group, you represent that you have the authority to bind all members of your group to these Terms, and you accept these Terms on their behalf.
B. Description of Services
Tuwuba Rugole Food Tours offers guided walking food tours through immigrant neighborhoods in the San Diego, California area. Tours include guided walking routes, visits to local restaurants and food establishments, food tastings, and printed neighborhood guides. The specific content, restaurants visited, and route of each tour may vary based on neighborhood, season, restaurant availability, and guide discretion.
We reserve the right to modify tour routes, restaurant stops, or other elements of the tour experience at any time and without prior notice, including on the day of the tour, when circumstances require it. Such modifications do not constitute grounds for a refund unless the tour is canceled entirely by us.
C. Reservations and Payment
Tour reservations are confirmed upon receipt of full payment or a deposit as specified at the time of booking. Prices are listed on our website and are subject to change without notice. The price applicable to your booking is the price confirmed at the time of your reservation.
Payment terms, accepted payment methods, and any applicable deposit requirements will be communicated during the booking process. All prices are in US dollars. You are responsible for any applicable taxes, fees, or charges associated with your payment method.
Reservations are not transferable to other tours without our prior written consent. Name changes to reservations may be accommodated at our discretion with advance notice.
D. Cancellations and Changes
Cancellations made at least 72 hours before the scheduled tour start time will receive a credit toward a future tour of equal value. This credit is valid for 12 months from the date of cancellation. Cancellations made less than 72 hours before the tour start time forfeit the tour fee.
We do not provide cash refunds except in cases where we cancel the tour ourselves. If we cancel a tour for any reason, including weather, safety concerns, or guide unavailability, you will receive a full credit toward a future tour or, at our discretion, a refund of the tour fee.
We may cancel or reschedule tours due to severe weather, public safety concerns, or other circumstances beyond our control. In such cases, we will make reasonable efforts to notify you as early as possible using the contact information you provided at booking.
E. Participant Conduct
All participants are expected to conduct themselves respectfully toward the guide, other participants, restaurant staff, and community members encountered during the tour. Disruptive, disrespectful, or unsafe behavior may result in removal from the tour without refund.
Tours take place in active neighborhood businesses and community spaces. Participants are expected to treat these environments with respect, follow the guidance of restaurant staff, and avoid behavior that disrupts other patrons. Excessive alcohol consumption prior to or during the tour is not permitted. Photography of food and public spaces is welcome, but participants should ask restaurant staff before photographing kitchen areas or staff members.
F. Health and Physical Condition
Tours involve walking distances of approximately 1.2 to 2 miles on public sidewalks and may include uneven terrain. Participants are responsible for assessing their own physical fitness and mobility before booking. We are not responsible for injuries resulting from a participant's failure to disclose a relevant health condition.
If you have food allergies, dietary restrictions, or health conditions that may be relevant to the tour, you must disclose these at the time of booking. While we will make reasonable efforts to accommodate disclosed needs, we cannot guarantee allergen-free food preparation at all restaurant stops. Participants with severe food allergies participate at their own risk.
G. Limitation of Liability
To the fullest extent permitted by applicable law, Tuwuba Rugole Food Tours, its officers, employees, guides, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in a tour or use of our website. Our total liability to you for any claim arising from or related to our services shall not exceed the amount you paid for the tour in question.
We are not responsible for the actions of third-party restaurant operators, other tour participants, or members of the public encountered during the tour. We are not responsible for any illness resulting from food consumed during the tour, including allergic reactions where the allergy was not disclosed to us in advance.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.
H. Indemnification
You agree to indemnify, defend, and hold harmless Tuwuba Rugole Food Tours and its officers, employees, guides, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your participation in a tour, your violation of these Terms, your violation of any applicable law, or your infringement of any rights of another person.
I. Intellectual Property
All content on this website, including text, images, graphics, and the neighborhood guides provided to tour participants, is owned by or licensed to Tuwuba Rugole Food Tours. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written permission. Personal, non-commercial use of website content for informational purposes is permitted.
J. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or your participation in our tours shall be resolved in the state or federal courts located in San Diego County, California, and you consent to the jurisdiction of such courts.
Before initiating any formal dispute resolution, you agree to contact us in writing to describe the dispute and provide us a reasonable opportunity to resolve it informally. We will make good-faith efforts to resolve disputes without formal proceedings.
